Who must register
Who needs to register in Florida?
Any charitable organization or sponsor that intends to solicit contributions in or from Florida, unless exempted under section 496.406.
Exemptions: There is no small-organization exemption. Every charity that solicits must register unless it falls in a category exempted by section 496.406.
Step by step
How to register for charitable solicitation in Florida
- Confirm your organization isn't exempt under section 496.406, Florida Statutes.
- Gather your documents: your most recent IRS Form 990 or 990-EZ (with Schedule O) or financial statement (a current-year budget if you're new), your IRS determination letter, and a list of officers and directors.
- List anyone who will fundraise for you for pay — professional solicitors, fundraising consultants or commercial co-venturers — and how they're compensated. FDACS asks for this.
- File the Solicitation of Contributions Registration Application (FDACS-10100) with FDACS and pay the fee for your contribution level ($10 – $400).
- Wait for FDACS approval before you start soliciting in Florida.
- Renew every year by the anniversary of your approval date, with updated financial information.
Late or missed filings: Florida charges a late fee of $25 for each month or part of a month after the renewal due date, and a registration can expire if the renewal or required financial statements aren't filed on time.
